Dog Training Class Service Contract

This Service Contract Is between Members Referred to herein as Handler(s) & The Trainer(s) of Near Me Creations LLC .  

Handler(s) may be referred to individually as the “Party and collectively as “Parties.”

Liability

Trainer will endeavor to create as safe an environment as possible for the training of Handlers dog and will endeavor to offer only sound, Safe, and responsible training, and training instructions. However, Handler(s) recognized that Trainer is not responsible for any unintentional errors, omissions, or incorrect assertions. Handler(s) understands that recommendation of any other products or services is not a guarantee of Handler(s) satisfaction with that product or any other products or service. Furthermore, Handler(s) will always remain responsible for the action of his/her dog. Handler(s) herby agree to abide by the rules and policies of Trainer’s training classes as set fourth in this contract. Handler(s) understand attendance of dog training classes is not without risk to Handler(s) member of Handler(s) family, guests who may attend, or to Handler(s) dog. In consideration of, and as inducement to the acceptance of Handler(s) application for training membership in this training class, Handler(s) agree to indemnify and hold harmless Trainer, it’s officers, directors, instructors, agents, employees, and/or representatives of any and all claims by any member of Handler(s) family, or accompanying guests of injury, expense, costs, or damages to Handler, his/her dog or any Handler both in class and out of class. In addition, Handler(s) agree that he/she will defend and indemnify Trainer for any injury, expense, costs, or damages to any dog Handlers or dogs, weather sponsored by Handler(s) or not, or to third parties arising out of Handlers own actions or the actions of his/her dog. Handler(s) has read the above- stated provisions and agrees to accept those responsibilities

Payment Policy

A Sign-Up payment in the amount of $20.00 will be necessary and covers week 1. There after $10.00 must be paid 24 hours prior to the start of the next class. Once payment is provided you will receive a one-time code, with a new code per session, to join the class. Payment Options are Zelle, Venmo

 

Cancellation Policy

Due to the price of the classes along with no contract, there will be no refunds. If you are unable to make it to a class reach out and you will be given the opportunity to enter another class with no additional charges for that 1 class. 

Class Room Rule

• Must Turn off screen during class

*    Trainer has the right to decline any dog or Handler for any reason seen. Rule braking will not be tolerated. Simply put, If Handler(s) are not able to follow rules the dog in question will not be able to either.

*    Handlers must be 18 years of age. I do encourage this to be a family event, however I need to make sure that questions and comments are being placed by responsible adults.

*    Trainer reserves the right to add, change, alter rules at any time, Proper announcement will be sent via email or class discussion. As classes get going rules will be updated as necessary

*    Zero tolerance rule

a.       No vulgar chats

b.      No criticizing

c.       No Chat fights

d.      No harassing Trainer or classmates

THIS WILL IMMEDIATELY TERMINATE YOU FROM THE ROOM WITH NO REFUND.

 

Modifications

This contract may not be changed or modified except by a new contract being provided in writing and signed by the Parties hereto. 

 

No Implied Waiver

The failure of either party to insist on strict performance of any covenant or obligation under this contract regardless of the length id time for which such failure continues, shall not be deemed a waiver of such Parties right to demand strict compliance in the future. No consent or waiver, express or implied, to or of any other breach of default in the performance of the same or any other obligation.

 

Notice

Any notice of other communication provided for herein or given hereunder to a Party hereto shall be in writing and shall be given in person, by email or by mail to the respective Party as follows.

Governing

This Contract shall be governed by the laws of the state of Michigan.

Counterparts/Electronic Signatures

This Contract may be executed in one or more counterparts, each of which shall be deemed an original but all of which shall constitute one and the same instructions. For purpose of this Contract, use of a facsimile-Mail, or other electronic medium shall have the same force and effect as an original signature 

 

Severability

Whenever possible each provision of this contract will be interpreted in such manner as to be effective and valid under applicable law, but if any provision of this contract is held to be invalid, illegal or unenforceable in any respect under any applicable law or rule in any jurisdiction, such invalidity, illegality, or unenforceable will not affect any other provision or anu other jurisdiction, but this contract will be reformed, construed, and enforced in such jurisdiction as if such invalid, illegal, or unenforceable provisions had ever been contained herein.

Successors and Assigns

All references in this contract to the Parties shall be deemed to include, as applicable, A reference to their respective successors and assigns. The provisions of this Contract shall be binding upon and shall inure to the benefit of the successors and assigns of the Parties.

Enter Contract

This Contract will not be amended by any verbal statement by whosoever made, and no such statement shall be binding upon Trainer unless the same shall have been reduced to writing and signed by Trainer. This contract constitutes the final, complete , and exclusive statement of the contract of the parties with respect to the subject matter hereof 

 

Headings

Headings used in this contract are provided for convenience only and shall not be used to construe meaning or intent.

 

Mandatory Arbitration

Any dispute under this contract shall be required to be resolved by binding arbitration of the Parties hereto. If the parties cannot agree on an arbitrator so selected shall arbitrate said dispute. The Arbitration shall be governed by the rules of the American Arbitration Association, then in forced and effect.
